The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.
The provider uses the log data without assigning it to the user's person or creating any other profile, in accordance with legal provisions, solely for statistical evaluations for the purpose of operating, securing, and optimizing the online offering. However, the provider reserves the right to subsequently review the log data if there is reasonable suspicion of illegal use based on concrete evidence.
SURVEY AND USE OF PERSONAL DATA
Personal data is only collected and used by the provider if this is permitted by law or if the users consent to the data collection. As a rule, users can see which data is stored when using the service, such as name, email address and message when using the order form.
The personal data provided for the purpose of ordering goods (such as name, email address, address, payment details) will be used by the seller to fulfill and process the contract. This data will be treated confidentially, transmitted in encrypted form and not passed on to third parties who are not involved in the ordering, delivery and payment process.
When contacting the provider (via contact form or email), the user's details are stored for the purpose of processing the request and in the event that follow-up questions arise.
The provider has taken organizational, contractual and technical security measures to ensure that the provisions of the data protection laws are observed and accidental or intentional manipulation, loss, destruction or access by unauthorized persons is prevented.
DATA CONTINUE LEAD TO THIRD PARTS
User data will only be forwarded to third parties if this is permitted by law or if a user has consented to the forwarding.
This is the case, for example, if the forwarding of data serves to fulfill contractual obligations to the user and the postal address is transferred to a shipping company after a shop order. Or if the data is requested by competent authorities such as law enforcement agencies.
The personal data of the users are in no way sold or passed on to third parties for advertising purposes or for the purpose of creating user profiles.
COOKIES
The provider uses "cookies" as part of its online offering. Cookies are small files that are stored on the user's computer and can store information for providers. Temporary cookies are deleted when the browser is closed, permanent cookies remain for a specified period of time and can make the stored information available when the online offering is accessed again.
Cookies are used to make it easier to use the service. For example, a cookie stores a user's shopping cart status.
The user can influence the use of cookies. Most browsers have an option that limits or completely prevents the storage of cookies. The provider endeavors to design the online offering in such a way that the use of cookies is not necessary. However, it should be noted that the use and in particular the comfort of use are restricted without cookies.
INFORMATION VERSAND BY NEWSLETTER
E-mails containing promotional information about the provider and its services are only sent with the express consent of the user. Users can object to receiving the newsletter at any time. An option to object can be found in every e-mail.
To register for the newsletter, the data requested during the registration process is required. The registration for the newsletter is logged. After registration, you will receive a message at the email address provided, asking you to confirm your registration ("double opt-in"). This is necessary so that third parties cannot register using your email address. Unconfirmed registrations are automatically deleted within four weeks at the latest. You can revoke your consent to receive the newsletter at any time and thus unsubscribe from the newsletter.
We store the registration data as long as it is required to send the newsletter. We store the registration log and the shipping address as long as there is an interest in proving the consent originally given. This is usually the limitation period for civil law claims, i.e. a maximum of three years.
The legal basis for sending the newsletter is your consent in accordance with Art. 6 para. 1 S. 1 a) in conjunction with Art. 7 GDPR in conjunction with Section 7 Paragraph 2 No. 3 UWG. The legal basis for logging the registration is our legitimate interest in proving that the dispatch was carried out with your consent.
Messages within the scope of the contractual relationship with the user are not considered advertising information. This includes the sending of technical information, information on payment processing, inquiries about orders and similar messages.
As part of the registration, the user agrees to the forwarding of his data to our external newsletter provider.
GOOGLE ANALYTICS
The provider uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on users' computers and that enable an analysis of your use of the website. The information generated by the cookie about the use of this website by users is usually transferred to a Google server in the USA and stored there.
However, if IP anonymization is activated on this website, Google will shorten the user's IP address beforehand within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. IP anonymization is active on this website. On behalf of the operator of this website, Google will use this information to evaluate the use of the website by users, to compile reports on website activity and to provide the website operator with other services relating to website activity and internet usage.
The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google. Users can prevent cookies from being saved by setting their browser software accordingly; however, the provider points out to users that in this case they may not be able to use all functions of this website to their full extent. Users can also prevent Google from collecting the data generated by the cookie and relating to their use of the website (including their IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=de.
USE OF FACEBOOK SOCIAL PLUGINS
This website uses social plugins (“plugins”) from the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are recognizable by one of the Facebook logos (a white "f" on a blue tile or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin." The list and appearance of the Facebook Social Plugins can be viewed here: https://developers.facebook.com/docs/plugins/.
When a user visits a website of this online offering that contains such a plug-in, their browser establishes a direct connection to the Facebook servers. The content of the plug-in is transmitted from Facebook directly to the user's browser and integrated into the website by the browser. The provider therefore has no influence on the extent of the data that Facebook collects using this plug-in and therefore informs users according to their level of knowledge: By integrating the plug-in, Facebook receives the information that a user has accessed the corresponding page of the online offering. If the user is logged in to Facebook, Facebook can assign the visit to their Facebook account. If a user interacts with the plug-in, for example by pressing the Like button or leaving a comment, the corresponding information is transmitted directly from your browser to Facebook and stored there. Even if a user is not a Facebook member, there is still a possibility that Facebook will obtain and store their IP address. According to Facebook, only an anonymized IP address is stored in Germany.
The purpose and scope of the data collection and the further processing and use of the data by Facebook as well as the relevant rights and setting options for the protection of the privacy of the users can be found in the Facebook data protection information: https://www.facebook.com/about/privacy/.
If a user is a Facebook member and does not want Facebook to collect data about him or her via this online service and link it to his or her member data stored on Facebook, he or she must log out of Facebook before visiting the website and delete the relevant Facebook cookies. It is also possible to block Facebook social plugins with add-ons for the browser, for example with the "Facebook Blocker".
USE OF HOTJAR
This website uses Hotjar, a web analytics tool. It anonymously records the interactions of randomly selected individual visitors with the website. This creates a log of, for example, mouse movements and clicks with the aim of identifying opportunities for improvement on the respective website. In addition, information about the operating system, browser, incoming and outgoing references (links), geographical origin, as well as the resolution and type of device are evaluated for statistical purposes. This information is not personal and is not passed on to third parties by Hotjar. If you do not want to be recorded, you can deactivate it on all websites that use Hotjar by setting the DoNotTrack header in your browser. Information about this can be found on the following page: overheat.de/opt-out.
RECALL, CHANGES, REPORTS AND UPDATES
The user has the right to request information about the personal data stored about him or her free of charge. Contact details can be found in the provider's imprint.
In addition, the user has the right to correct incorrect data, blocking and deletion of his personal data, provided there is no legal obligation to retain it.
Changes to the privacy policy
The provider reserves the right to change the privacy policy in order to adapt it to changes in the legal situation or in the event of changes to the service or data processing.
CREDIT CHECK AND SCORING
If we make advance payments, e.g., when purchasing on account, we may obtain a credit report from Schufa based on mathematical-statistical procedures to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to Schufa and use the information obtained regarding the statistical probability of a payment default to make a balanced decision regarding the establishment, implementation, or termination of the contractual relationship. The credit report may contain probability values (score values) calculated based on scientifically recognized mathematical-statistical procedures and including address data. Your legitimate interests will be taken into account in accordance with legal provisions.
